  1. Appointment
    • The client agrees to not represent themselves as a representative, agent, contractor or employee of the Provider. The Provider is not reliable for any representation, act or omission by the client.
    • The Client has the right to engage with the Provider during, and following, their services. This is unless lines of communication are terminated by either party.
    • The Client agress to engage with the Provider, and the Provider agrees to provide the service(s) and/or product(s) to the client
  2. Obligations of Provider
    • It is the provider's responsibility to fully cooperate with the client at all times in order to achieve the best possible outcome for the Client's service/product.
    • The provider will provide services/products with skill and care, in accordance to industry standards.
    • The provider will ensure contractors providing services/products have the skill to provide a quality final product to the client
  3. Obligations of Client
    • The Client is responsible for making the Provider aware of all relevant information for their business. This helps the provider maintain their obligations.
    • The Client shall not use the services carried out by Pixelite Digital for illegal activity.
    • Where necessary, the client should provide visual media to the provider for usage in graphical designs, social media, and websites. Any media that has to be created by the provider, or sourced by the provider, may be charged at an additional cost.
    • The client is responsible for looking after, and not misplacing, the work provided by the provider. In the scenario that work is lost by the client, and the provider no longer holds the work, the provider holds no responsibility.
  4. Scope of Work
    • Scope and extent of work are outlined in the original quotation, and the amount in the quotation reflects this workload.
    • Any further requests for work will be charged at a further rate, which will be agreed on by the client and provider at the time. It is at the discretion of the provider if the request is outside of the original scope.
    • The client will have 7 working days after the completion of the work to raise any issues with the provider. Protocol from our our complaints procedure should be followed.
  5. Fees & Expenses
    • The Client shall pay the Provider the full value of the sum included in their quotation, prior to any work being commenced by the provider. This includes fees involving the domain name. Alternative payment agreements may be agreed upon, in which case terms and conditions will be discussed with the client as and when necessary.
    • Upon being issued a fee note, i.e. an invoice, this is to be paid within 7 days of completion of work. If payment has not been received, the provider reserves full right to suspend further work for the client until payment has been fully received.
    • Upon payment being received, any relevant domains will be transferred to the client. Please refer to the 'Domain Names' section of these terms and conditions for further information.
  6. Confidentiality
    • The provider (Pixelite Digital) vowes to keep confidential information secret and confidential. Confidential information is to be considered confidential until it's released into the public domain. This may change in situations where law requires confidential information to be released.
    • The provider will ensure that employees and contractors are fully aware of these obligations and confidentiality to the client.
  7. Terms and Conditions
    • The provider (Pixelite Digital) has the right, and ability, to change these Terms and Conditions. It is the responsibility of the client to keep up-to-date with these terms and conditions.
    • It is the provider's responsiblity to update the 'last edited' field on this page whenever the terms and conditions are changed. This should be an indicator to the client that the terms and conditions were altered on this date.
  8. Social Media Management
    • Social Media Management services offered by Pixelite Digital are aimed at increasing traffic, but are not guaranteed to. It should be understood by the client that social media management doesn't yield instant results, and can take time.
    • The algorithms of social media services are out of Pixelite Digital's control. They can change unknowingly, and subsequently impact the performance of your social media. This is out of Pixelite Digital's control, and we hold no responsibility in such events.
    • Payments for social media management services are non-refundable, unless extraordinary circumstances call for otherwise.
    • If a payment is late for social media management services, Pixelite Digital reserves the right to halt services until payment has been received. This might mean missed posts/scheduled content until payment has been received.
    • The Client shall provide necessary content/images that can be displayed on social media. This will assist in achieving the best performance on the client's social media.
  9. Domain Names
    • Pixelite Digital offers clients domain names in certain packages. It should be understood that, until payment is fully received from the client to the provider (Pixelite Digital), the provider will be the owner of the domain name.
    • Upon the domain being transferred, it is the responsibility of the client to read the terms and conditions of the relevant domain registry. These terms and conditions must be complied by thereafter.
    • If the client fails to produce payment for the domain, the client will be responsible for paying the cancellation fee for the relevant domain.
  10. Social Media Optimisation (SEO)
    • Pixelite Digital have zero control over the ranking alogrithms of search engines. Algorithms used by search engines are constantly changing, and the content and/or sites allowed one day, could change another. It is as the discretion of a search engine if they exclude/limit your site, completely out of Pixelite Digital's control.
    • Pixelite Digital is unable to guarantee top placements for competitive keywords and phrases. Search engines are competitive, and SEO efforts don't always guarantee the top places. We do not guarantee Number One, or top 10 positions for any keyword, phrase or search term.
    • Clients should understand that ranking new websites can take time, and that search engines naturally take a while to index and register newer sites. Instant results won't be seen, and should not be seen as form of under performance. Old, established websites will naturally adapt to SEO at a faster pace due to already being indexed, and having a foundation to be built on.
  11. Graphical Design
    • It should be understood that graphical designs (logos, graphics, visual media) are quoted with the assumption of 3 revisions (sets of alterations). Any further alterations may be charged, at the discretion of the provider, at an extra cost. The client will be made aware of this at the time.
    • After the final logo design is approved, the logo design will be sent to you as digital files. It is the responsibility of the client to provide an appropriate destination for these files to be sent to.
    • It is the responsibility of the client to provide the provider with any necessary information to be present on the graphical design. The ommitance of information could be included as a revision/set of alterations, at the complete discretion of the provider.
  12. Testimonials
    • The provider maintains the right to request usage of the produced work as a means of promoting their business, in both physical and digital formats. The client will be asked for consent for this, at which point the provider is responsible for respecting the words of the client.
    • If, at any point, the client no longer wants the produced work to be used as a form of promotion on behalf of the provider, this issue must be raised to the provider. The provider can not guarantee the removal of all usage of produced work (i.e. on social media), although can guarantee the ceasement of using this work, as a form of promotion, in the future. Any complaints should be expressed in a written format, preferrably emailed to business@pixelite.digital
  13. Timescales and Deadlines
    • Although we, Pixelite Digital, try our best to provide accurate, and consistnet deadlines, timescales are provided based on current working pace. Timescales can fluctuate depending on both internal and external factors, many of which are out of our control.
    • It should be understood that Pixelite Digital will keep you up to date with any changes in deadline, and reimburse accordingly for time lost (if applicable).
